These Terms of Service ("Terms") govern your use of the Pawmark mobile application and related services ("Pawmark", the "Service"). By creating an account or using Pawmark, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use Pawmark. If you are under 18, you may use the Service only with the involvement and consent of a parent or guardian. By using Pawmark, you represent that you meet these requirements and that any information you provide is accurate.
You are responsible for your account credentials and for all activity under your account. Notify us promptly at support@pawmark.app if you suspect unauthorized use. You may delete your account at any time in the app under Profile → Delete Account.
Pawmark is built around shared households. When you join a household, content you add (pets, habits, appointments, expenses, records, notes, and photos) is visible to the other members of that household, and content relating to household pets may remain with the household after you leave or delete your account. Invite codes let anyone holding them request to join your household; you are responsible for sharing invite codes only with people you trust.
Pawmark is an organizational tool, not a veterinary service. Nothing in the Service (including reminders, schedules, records, tracking features, or any content) constitutes veterinary, medical, or professional advice. Always consult a qualified veterinarian for decisions about your pet's health. You are solely responsible for the care of your pets.
Notifications and reminders depend on your device settings, network conditions, and third-party delivery services, and may be delayed or fail to arrive. You must not rely on Pawmark as your sole means of remembering medication, vaccinations, feeding, or any other care your pet needs. We are not responsible for any consequences of a missed, delayed, or failed reminder.
You retain ownership of the content you add to Pawmark. You grant us a limited, non-exclusive license to host, store, process, and display that content solely to operate the Service, for example syncing it to the members of your household. You are responsible for the content you upload and must have the right to share it.

Pawmark is currently provided free of charge. We may add, change, or remove features, or discontinue the Service, at any time. If we ever introduce paid features, we will communicate pricing clearly before you are charged.
The Service relies on third-party providers, including Apple and Google (sign-in), Supabase (hosting), Expo (notification delivery), and Mapbox (address search). Their services are governed by their own terms, and we are not responsible for their availability or performance.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST. YOU SHOULD MAINTAIN YOUR OWN RECORDS OF CRITICAL INFORMATION, SUCH AS VACCINATION CERTIFICATES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWMARK AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING, WITHOUT LIMITATION, ANY HARM TO A PET ARISING FROM RELIANCE ON THE SERVICE OR FROM A MISSED, DELAYED, OR FAILED REMINDER. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US $50) OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.
You agree to indemnify and hold harmless Pawmark and its operator from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms.
If you obtained Pawmark from the Apple App Store: these Terms are between you and Pawmark's operator, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it. Apple is a third-party beneficiary of these Terms and may enforce them against you.
You may stop using the Service or delete your account at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Sections 4, 5, 6, and 10 to 16 survive termination.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts located in Delaware, and you consent to their jurisdiction. You agree that any claim must be brought within one year of when it arose, and only on an individual basis, not as part of a class or representative action, to the extent permitted by law.
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We may update these Terms from time to time; if changes are material, we will notify you in the app or by email, and your continued use after the effective date constitutes acceptance.
